Legislative background to the Garda Síochána Ombudsman Commission

The primary legislation applying to the Garda Síochána Ombudsman Commission is the Garda Síochána Act 2005.

PART 3 (Sections 63 - 81) covers the establishment and functions of the Garda Síochána Ombudsman Commission.

Section 67 - describes the objectives, fundations and powers of the Commission

PART 4 (Sections 82 - 112) covers complaints, Investigations and other procedures

Section 84 - sets out the time limits for making complaints

Section 86 - explains what happens if a complaint is made directly to the Commission

Section 87 - on the determination of whether a complainat is admissable

Section 90 - sets out how complaints are resolved by mediation or other informal means

Section 91 - explains the investivation of complaints concerning the death or, or serious harm to a person

Section 93 - on the power to discontinue investigation

Section 106 - on the examination of certain practices, policies and procedures of the Gardai

Section 110 - on the offence of providing false or misleading inforamtion
