Legislative background for legal aid certificates

The main legislation applying is the Criminal Justice (Legal Aid) Act 1962. This applies to:

  • Legal aid (District Court) certificate
  • Legal aid (trial on indictment) certificate
  • Legal aid (appeal) certificate
  • Legal aid (case stated) certificate
  • Legal aid (Supreme Court) certificate

The legislation applying to the Special Criminal Court certificate is Section 30 of S.I. No. 234 of 1975 Special Criminal Court Rules, 1975.

The Criminal Justice Act 2006 applies to the following:

  • Section 165 – Legal aid (behaviour order) certificate
  • Section 118 – Legal aid (civil order) certificate

Section 27 of the Criminal Justice Act 2007 applies to the following:

  • Legal aid (monitoring order) certificate
  • Legal aid (protection of persons order) certificate

Section 11 of the Criminal Procedure Act 2010 applies to the legal aid (re-trial order) certificate.
