Legislative background for Jobseeker's Allowance


The main provisions relating to Jobseeker's Allowance (previously called Unemployment Assistance) are contained in Chapter 2 of Part III of the Social Welfare Consolidation Act, 2005 (pdf), as amended.

The Social Welfare Law Reform and Pensions Act 2006 (pdf) allows for the name Unemployment Assistance to change to Jobseeker's Allowance. The new name came into effect on 4 October, 2006.

Section 3 of the Social Welfare (Temporary Provisions) Regulations, 2001 provides for a bonus payment of 100% to all recipients of long-term social welfare payments. This payment is normally made in the early part of December each year and is made in addition to the payment ordinarily due that week.

The main provisions relating to the assessment of spouse/partner's earnings are contained in Rule 1(2), 1(7), 1(8) and Rules 3 and 4 of Schedule 3 of the Social Welfare (Consolidation) Act, 2005.
